New law to end illegal downloading of music and moves in Malaysia




This new law called the ISP Liability act, will be presented in Parliament next month in Malaysia, according to Recording Industry Association of Malaysia (RIM) chairman Norman Halim.the law will enable Internet Service Providers (ISP) to suspend or terminate the Internet accounts of  peer-to-peer users.The act makes the ISP s responsible for controlling  online piracy. The ISPs will be fined if they don’t take action against illegal down loaders. every  ISPs have well equipped with  the technology to track P2P users,.the procedure  of warning will be like this, at first time  ISP s will send two warning letters to illegal downloaders.if downloadres still persist the internet access will be suspended. However, the amount of fine has not been announced

  1. Malaysia is one of the those countries which recently are more sensitive towards the copyright.
    according to Copyright Act 1987, a party is liable for copyright infringement if they violate the exclusive right of the original copyright owner. For ISP, they are three categories that fall under ISP liabilities which are:

    1. Direct liability
    2. vicarious liability
    3. contributory liability

  2. file sharing and music are those issues which is current in internet users. file sharing is involving violation of copyright laws as digital copies of copyrighted materials are transferred between users. in Malaysia n June 2011, the Malaysian Communications and Multimedia Commission has ordered the blocking of several websites including The Pirate Bay and several file-hosting websites via a letter dated 30 May to all Malaysian ISPs for violating Section 41 of the Copyright Act 1987, which deals with pirated content.
